The Local Government Act 2009 gives Local Buy a statutory right to complete the public tender process, for goods and services, on behalf of Queensland’s Local Government sector. Our contracts are fully compliant with the requirements of the Act and subsequent financial regulations.
The Local Government Act 2009 & Local Government Regulation 2012 stipulate certain requirements of councils when entering into contracts:
However, councils may stipulate lower thresholds and additional processes in regards to entering into contracts. Some councils have an internal policy which states they must seek three quotes, regardless of using Local Buy suppliers; or if the amount is above $1,000 rather than the mandated $15,000 – so they are seen to be seeking best value.
All Queensland Local Government Authorities can purchase without tendering or requesting multiple quotes, when engaging Local Buy suppliers. More information on the Local Government Act and Regulations can be found on the Local Buy website.
Please also be aware that under the Local Government Regulation 2012, all Queensland Councils are required to make public, details of all contracts awarded which have a value of $200,000 or more per financial year (ie project, name of company, value of project and how the company was awarded the work – public tender/Council panel/Local Buy supplier). Generally this information can be found on individual Council websites.
